Legalese

Welcome to the Musiekwêreld website. This website is owned and operated by Musiekwêreld.

By accessing or using this website, submitting a stock request, creating an account or purchasing products from us, you agree to the terms set out on this page. Please read them carefully before using the website.

Business information

Musiekwêreld is a South African musical instrument and audio equipment retailer.

You can contact us by telephone on +27 21 949 4070 or by email at info@musiekwereld.co.za.

Website use

You may use this website to browse products, request stock information, submit enquiries, create an account and place orders where online purchasing is available.

You agree to use the website only for lawful purposes. You may not interfere with the website’s operation or security, attempt to gain unauthorised access to any part of the website, introduce viruses or harmful code, extract or reproduce website content without permission, submit false or misleading information, or use the website in a way that infringes the rights of Musiekwêreld or any third party.

We reserve the right to restrict or suspend access to the website where we reasonably believe that these terms have been breached.

Product information

We take reasonable care to ensure that product names, descriptions, photographs, specifications and prices displayed on the website are accurate.

Product images may differ slightly from the product received because of lighting, screen settings, manufacturer updates or variations between models. Images are provided for illustrative purposes unless stated otherwise.

Product specifications, packaging, finishes, colours and included accessories may be changed by the manufacturer without notice.

Where a product description or price contains an obvious error, we reserve the right to correct the information and contact you before processing the order.

Product availability and stock requests

Products displayed on the website may not always be immediately available.

Submitting a stock request does not automatically reserve a product, guarantee availability or create a binding sale. A stock request is an enquiry regarding the availability and potential purchase of the selected products.

We may contact you to confirm whether the requested products are available, the applicable price, expected delivery or collection dates, payment requirements and any suitable alternatives.

A purchase is only confirmed once Musiekwêreld has accepted the order and any required payment has been successfully received.

Orders and acceptance

Placing an order through the website constitutes an offer to purchase the selected products.

We reserve the right to accept or decline an order for reasonable grounds. These may include a product being unavailable, an incorrect price or product description, suspected fraudulent activity, payment not being authorised, delivery being unavailable to the selected location, or limitations imposed by a supplier or manufacturer.

An automated email acknowledging receipt of an order or stock request does not necessarily constitute final acceptance of the order.

The sale will be regarded as accepted when we confirm the order or notify you that the products are ready for collection or dispatch.

Prices and payment

All prices are displayed in South African rand unless stated otherwise.

Prices include value-added tax where applicable. Delivery, courier, installation or other additional charges may be calculated separately and shown before payment or communicated to you when confirming a stock request.

Available payment methods will be displayed during checkout or communicated directly by Musiekwêreld.

You confirm that you are authorised to use the payment method supplied and that the payment information provided is accurate.

Musiekwêreld does not store complete payment card details where payments are processed through an independent payment service provider. Payment transactions may be subject to the terms, security measures and privacy practices of the relevant payment provider.

Delivery and collection

Delivery dates and times are estimates unless expressly confirmed in writing.

We will take reasonable steps to process and dispatch orders promptly, but delivery may be affected by supplier delays, courier disruptions, product availability, public holidays, adverse weather or other circumstances outside our reasonable control.

Responsibility for the products will pass to you when they are delivered to the address provided or collected by you or your authorised representative.

You are responsible for ensuring that the delivery address is complete and accurate, that someone is available to receive the order, that products are inspected as soon as reasonably possible after delivery, and that any visible damage or missing items are reported promptly.

Additional delivery charges may apply where an order must be redirected or delivered again because incorrect information was supplied or nobody was available to receive it.

Returns, exchanges and refunds

Returns, exchanges and refunds are subject to Musiekwêreld’s Returns Policy and applicable South African consumer law.

Products should be returned with the original packaging, accessories, manuals and proof of purchase where reasonably possible.

Products that have been damaged through misuse, neglect, unauthorised modification, incorrect installation or failure to follow the manufacturer’s instructions may not qualify for a refund or exchange.

For hygiene and copyright reasons, certain products may not be eligible for return once opened, used or unsealed, except where the product is defective or the law provides otherwise. These may include earphones, in-ear monitors, microphones, harmonicas, mouthpieces, reeds, software and recorded media.

Nothing in these terms is intended to limit any rights that a consumer may have under applicable South African law.

Warranties and defective products

Products may be covered by a manufacturer’s or supplier’s warranty.

Warranty periods and conditions differ between products and brands. Warranty claims may require proof of purchase, the product serial number and an assessment by Musiekwêreld, the supplier or an authorised service centre.

A warranty may not cover damage caused by accidents, misuse, incorrect storage, transport damage, liquid damage, moisture, heat, electrical damage, power surges, normal wear and tear, unauthorised repairs or modifications, poor maintenance, or use that is inconsistent with the manufacturer’s instructions.

Any manufacturer’s warranty applies in addition to rights provided under applicable consumer legislation.

Second-hand, demo and clearance products

Second-hand, demonstration, discontinued and clearance products may show signs of use, handling, display or damaged packaging.

Any known material defects or limitations will be disclosed where reasonably possible before purchase.

These products may be sold subject to different warranty arrangements, which will be communicated in the product description, quotation, invoice or other written correspondence.

Your statutory rights regarding undisclosed defects are not excluded.

Customer accounts

You may be required to create an account to access certain website features.

You are responsible for keeping your login details confidential, providing current and accurate information, updating your information when it changes, and notifying us if you suspect unauthorised access to your account.

You are responsible for activity conducted through your account unless the account was accessed because of a security failure for which Musiekwêreld is legally responsible.

We may suspend or close an account where it has been used fraudulently, unlawfully or in breach of these terms.

Personal information and privacy

Musiekwêreld may collect and process personal information when you visit or interact with the website, create an account, submit an enquiry or stock request, place an order, subscribe to marketing communications, contact customer support, or participate in a promotion or survey.

Personal information may include your name, contact details, delivery address, account information, transaction details and website usage information.

We process personal information for legitimate business and legal purposes. These purposes may include responding to enquiries, processing stock requests and orders, arranging payment, delivery and collection, managing customer accounts, providing customer service, preventing fraud, improving security, maintaining business records, improving the website and our services, complying with legal obligations, and sending marketing communications where permitted.

Further information about how we collect, use, store and protect personal information is available in our Privacy Policy.

The website may use cookies and similar technologies to enable essential website functions, remember preferences, maintain shopping carts and account sessions, understand how visitors use the website, improve performance, and support advertising or marketing activities.

You can manage non-essential cookies through the website’s cookie settings or your browser. Disabling certain cookies may affect how parts of the website operate.

Marketing communications

Where you have consented to receive marketing communications, Musiekwêreld may send you information about products, promotions, events and store updates.

You may unsubscribe at any time by using the unsubscribe option provided in the communication or by contacting us.

Service messages relating to an order, account, payment, stock request or customer enquiry are not regarded as promotional marketing and may still be sent where necessary.

Intellectual property

Unless otherwise stated, all website content is owned by or licensed to Musiekwêreld.

This includes text, product descriptions, graphics, artwork, photographs, videos, logos, branding, website design, page layouts, databases and downloadable material.

You may view and use the website for personal, non-commercial purposes.

You may not reproduce, republish, modify, distribute, sell or commercially exploit website content without prior written permission from Musiekwêreld or the relevant rights holder.

Product names, logos and trademarks belonging to manufacturers or suppliers remain the property of their respective owners.

Third-party websites and services

The website may contain links to websites, payment providers, social media platforms or services operated by third parties.

These links are provided for convenience. Musiekwêreld does not control third-party websites and is not responsible for their availability, content, security, terms or privacy practices.

Accessing a third-party website is at your own discretion and may be subject to separate terms and conditions.

Website availability

We aim to keep the website available and functioning correctly, but we do not guarantee uninterrupted or error-free access.

The website may be temporarily unavailable because of maintenance, technical problems, security concerns, hosting interruptions or circumstances outside our reasonable control.

We may update, suspend, withdraw or change any part of the website without notice where reasonably necessary.

Limitation of liability

To the fullest extent permitted by law, Musiekwêreld will not be liable for indirect, incidental or consequential loss arising from the use of, or inability to use, the website.

This may include loss resulting from website interruptions, inaccurate information supplied by a third party, unauthorised access caused by a user failing to protect account details, malicious software introduced by a third party, or reliance on general information published on the website.

Nothing in these terms excludes or limits liability where doing so would be unlawful, including liability that cannot be excluded under applicable consumer protection legislation.

Indemnity

To the extent permitted by law, you agree to indemnify Musiekwêreld against claims, losses or expenses arising directly from your unlawful use of the website, your infringement of another person’s rights or your material breach of these terms.

This clause does not apply where the loss was caused by the negligence, unlawful conduct or breach of duty of Musiekwêreld.

Changes to these terms

We may update these terms periodically to reflect changes to the website, our services, our business practices, payment or delivery processes, or applicable laws and regulations.

The updated version will be published on this page with a revised effective date.

Your continued use of the website after an update means that the revised terms will apply to subsequent use and transactions.

Governing law

These terms are governed by the laws of the Republic of South Africa.

Any dispute will be dealt with by a court or other body with lawful jurisdiction in South Africa, subject to any rights you may have under applicable consumer protection legislation.

Severability

If any part of these terms is found to be invalid or unenforceable, that provision will be interpreted or limited to the minimum extent necessary.

The remaining provisions will continue to apply.

No waiver

A failure or delay by Musiekwêreld to enforce any provision of these terms does not constitute a waiver of that provision or any other right.
